Terms and Conditions

These Terms and Conditions apply to all orders placed and supplied by The School Photography Company Ltd (“we”, “us”, “our”).


1. Ordering and Payment

  1. Orders must be placed via our secure online ordering system.
  2. Full payment is required at the time of ordering.
  3. We accept payment methods listed at checkout on our ordering platform.
  4. Orders will only be processed once payment has been successfully received.
  5. We are PCI DSS compliant and do not retain any information regarding your credit or debit card number, expiry date or card security code.


2. Pricing and VAT

  1. All prices are shown in GBP (£).
  2. Prices include VAT where applicable.
  3. We reserve the right to amend pricing; however, confirmed and paid orders will not be affected.


3. Proofs and Image Selection

  1. Proof thumbnail images are supplied online for selection purposes only.
  2. Colours, cropping and brightness may vary slightly between on-screen proofs and printed products.
  3. It is the customer’s responsibility to check image selection and product choice before confirming the order.


4. Delivery

  1. When delivery to school is selected:
  2. Orders are dispatched within 21 days of the “Order by” deadline date.
  3. Group photographs; could be delayed beyond our stated 21 days if we are waiting for your School to authorise the release of the photographs.
  4. When delivery to home is selected:
  5. Orders are dispatch within 21 days.
  6. Group photographs; could be delayed beyond our stated 21 days if we are waiting for your School to authorise the release of the photographs.
  7. Estimated dispatch times are provided as guidance only.
  8. Delivery delays:
  9. Packages can still be classed as in transit up to 14 days from the date that it has been dispatched. Therefore, if you have not received your order, please wait 14 days from the date that you are notified of dispatch before contacting us. If 14 days have passed then please contact us either by email on [email protected] or call 01295 250812 and select option 1, we will then be happy to help trace your lost or delayed order.
  10. You must notify us within two months of dispatch if you have not received your order as after this time we cannot trace an order with our delivery agents and it is deemed reasonable to assume that the customer has already received their order.
  11. We are not responsible for delays caused by events beyond our reasonable control.


5. Right to Cancel (Distance Sales)

  1. Under the Consumer Contracts Regulations 2013, consumers normally have a 14-day cancellation right for distance purchases.
  2. However, this right does not apply to personalised or bespoke goods. School photographs are custom products and therefore are exempt from the standard cancellation period once production has begun.
  3. Orders may be amended or cancelled prior to printing by contacting us immediately.


6. Returns, Reprints and Refunds

  1. If products are faulty, damaged, or not as described, customers must notify us within 7 days of receipt.
  2. In accordance with the Consumer Rights Act 2015, customers are entitled to a repair, replacement, or refund where goods are faulty.
  3. Refunds will not be issued for dissatisfaction relating to facial expression, pose, hairstyle, or personal preference once the image has been selected.
  4. Claims must be supported with clear evidence (e.g., photograph of damage).


7. Digital Image Orders

  1. Digital downloads are licensed for personal, non-commercial use only.
  2. Images must not be sold, redistributed, or used for commercial purposes without written consent.
  3. Copyright remains the property of The School Photography Company Ltd (see section 9).
  4. Digital files will be delivered by accessing the download section of our website after purchase. If you experience download issues, contact us at: [email protected]
  5. We do log when a digital image is accessed and downloaded. Due to the digital nature of the products, all sales are final. 
  6. You cannot request to change the image selected.
  7. You cannot add images to the order to take advantage of the multiple digital image offer, when available.
  8. Refunds may be issued only if; the file provided is corrupted or the wrong file was delivered.
  9. We are not responsible for:
  10. Printing quality variations
  11. Colour differences due to monitor settings
  12. Third-party misuse of images
  13. You may not use our digital images:
  14. In illegal activities
  15. In defamatory, obscene, or hateful content


8. Data Protection and Privacy

  1. We process personal data in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018.
  2. Personal data is collected solely for the purpose of processing orders and delivering products.
  3. Images will not be used for marketing or promotional purposes without appropriate consent from the school and/or parent/guardian.
  4. Data is retained only for as long as necessary to fulfil our contractual and legal obligations.


9. Copyright and Intellectual Property

  1. All photographs and digital images produced by The School Photography Company Ltd are protected by copyright under the Copyright, Designs and Patents Act 1988.
  2. Copyright in all images remains the exclusive property of The School Photography Company Ltd.
  3. The purchase of prints or digital images does not transfer copyright ownership.
  4. Images must not be:
  5. Sold or used for commercial purposes
  6. Copied, published or reproduced without written permission
  7. The removal or alteration of any watermark, copyright notice, or branding is strictly prohibited.
  8. The School Photography Company reserves the right to take appropriate legal action in the event of unauthorised use or copyright infringement.


10. Limitation of Liability

  1. Our liability is limited to the value of the goods purchased.
  2. We shall not be liable for indirect or consequential losses.
  3. Nothing in these Terms limits liability for death or personal injury caused by negligence or for fraud.


11. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
